By accessing or using Safe in Sound ("the App"), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. Description of Service
Safe in Sound is a mobile application designed to help users limit and control device volume levels to protect hearing health. The App provides:
- Volume limiting functionality with customizable thresholds
- Passcode-protected settings to prevent unauthorized changes
- Security question recovery for forgotten passcodes
- Real-time volume monitoring and enforcement, including in the background
- Face ID and Touch ID authentication (optional)
- Tamper detection alerts when repeated override attempts are made
- Haptic feedback and visual indicators
3. Use License
Grant of License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes.
License Restrictions
You agree NOT to:
- Modify, reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices from the App
- Use the App for any commercial purposes without written permission
- Rent, lease, lend, sell, redistribute, or sublicense the App
- Copy the App except as expressly permitted by Apple's usage rules
- Use the App in any manner that violates applicable laws or regulations
4. User Responsibilities
Passcode Management
You are solely responsible for:
- Creating and maintaining the security of your passcode
- All activities that occur under your passcode
- Keeping your passcode confidential and secure
Important: If you forget your passcode, you can reset it using your security question (if set up) or by contacting support with your unique install identifier. As a last resort, deleting and reinstalling the App will erase all settings and allow you to start fresh.
Appropriate Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the App complies with all applicable laws and regulations.
5. Limitations of the Service
Not Medical Advice
The App is designed as a hearing protection tool but is not a substitute for professional medical advice, diagnosis, or treatment. You should consult with qualified healthcare professionals regarding:
- Hearing health concerns
- Appropriate volume levels for your specific situation
- Existing hearing damage or conditions
- Medical questions about hearing protection
System Limitations
While the App works to enforce volume limits, certain system-level limitations may affect its operation:
- iOS system updates may impact functionality
- Some audio sources may bypass volume controls
- Emergency alerts and system sounds may exceed set limits
- The App requires proper iOS permissions to function correctly
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be uninterrupted or error-free
- Warranties regarding the accuracy or reliability of information
- Warranties that the App will prevent all hearing damage
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAFE IN SOUND, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Hearing damage or health issues related to device usage
- Inability to access the App or loss of stored data
- Any damages arising from your use or inability to use the App
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
8. Indemnification
You agree to indemnify, defend, and hold harmless Safe in Sound and its developers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any harm caused to minors under your supervision
9. Subscriptions and Purchases
Subscription Plans
Safe in Sound offers subscriptions that unlock full access to the app's features. Subscription options include:
- Monthly: Auto-renewing monthly subscription
- Yearly: Auto-renewing annual subscription
- Lifetime: One-time purchase with permanent access
Free Trial
New users receive a 7-day free trial with full access to all features. No payment is required during the trial period. After the trial expires, a subscription is required to use the volume locking feature.
Billing and Renewal
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions in your Apple ID Account Settings
- Any unused portion of a free trial period will be forfeited when you purchase a subscription
Refunds
All purchases are processed through Apple's App Store. Refund requests must be made through Apple. We do not have the ability to process refunds directly.
10. Privacy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your data.
Key points:
- We do not collect any personal information
- All app data stays on your device
- RevenueCat is used solely for subscription management (purchase history only, not linked to identity)
- No analytics or tracking is performed within the app
11. Updates and Modifications
App Updates
We may release updates to improve functionality, fix bugs, or add features. Updates may:
- Be automatically downloaded if you have enabled automatic updates
- Require your acceptance of additional or modified Terms
- Change or remove features without notice
Terms Updates
We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.
12. Termination
Termination by You
You may stop using the App at any time by deleting it from your device.
Termination by Us
We reserve the right to:
- Discontinue the App at any time without notice
- Revoke your license to use the App for violation of these Terms
- Remove the App from the App Store
13. Third-Party Services
Apple App Store
The App is distributed through Apple's App Store and subject to Apple's terms and conditions. You acknowledge that:
- These Terms are between you and Safe in Sound, not Apple
- Apple has no obligation to provide maintenance or support
- Apple is not responsible for the App or any claims related to it
- Your use must comply with Apple's App Store Terms of Service
14. Intellectual Property
All rights, title, and interest in and to the App, including all intellectual property rights, are and will remain the exclusive property of Safe in Sound. These Terms do not grant you any rights to our trademarks, logos, or brand features.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of North Carolina, United States, without regard to conflict of law provisions.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Good faith negotiation between the parties
- If negotiation fails, binding arbitration in accordance with applicable arbitration rules
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Safe in Sound regarding the App and supersede all prior agreements and understandings.
